  1. Principles of data processing; data security

1.1. The Service Provider, acting as the Data Controller (hereinafter: Data Controller), undertakes to process personal data obtained during its activities in accordance with the applicable legal regulations – as described in this Privacy Notice.

The Data Controller processes personal data only for specific purposes, in order to exercise rights and fulfill obligations.

The collection and processing of data – at every stage of data processing – complies with the requirements of fairness and lawfulness.

The Data Controller processes only personal data that are essential for achieving the purpose of the processing and are suitable for achieving that purpose. The Data Controller processes personal data only to the extent and for the duration necessary to achieve the purpose.

At every stage of data processing, the Data Controller ensures that the data subject may at any time learn which data types are processed by the Data Controller for which purposes, and may at any time prohibit the processing – except in cases of mandatory data processing.

The purposes of data processing and the scope of the processed data are specified in Section 2 of this Privacy Notice.

This Privacy Notice complies with the following legislation:

  • Act CVIII of 2001 on certain issues of electronic commerce services and information society services
  • Act CXII of 2011 on the right to informational self-determination and freedom of information

1.2. The Data Controller designs and carries out data processing operations in such a way as to ensure the protection of the privacy of data subjects.

The Data Controller ensures the security of the data and takes the technical and organizational measures necessary to enforce the provisions of Act CXII of 2011 and other data protection and confidentiality regulations.

The Data Controller protects the data against unauthorized access, alteration, transmission, disclosure, deletion or destruction, as well as against accidental destruction or damage and inaccessibility resulting from changes in the applied technology.

  1. Legal basis of data processing; purpose; processed data

2.1. Personal data may be processed if the data subject consents, or if it is required by law, or – within the scope defined by law – by a local government decree for a purpose based on public interest.

2.2. The declaration of consent of a minor who has reached the age of 16 is valid without the consent or subsequent approval of their legal representative.

2.3. In the case of registration on the website https://forgarden.hu/ and in the case of sending newsletters, data processing is based on the voluntary consent of the data subject – given after appropriate information. The declaration of the data subject is required for registration and – if separately consented to – for sending newsletters.

The data subject gives consent prior to registration by placing an “X” in the checkbox displayed next to the Privacy Notice during the registration process. Before giving consent, the data subject may read and become familiar with the contents of this Privacy Notice. By giving this consent, the data subject accepts the contents of the Privacy Notice.

This Privacy Notice is continuously available in the footer of the website https://forgarden.hu/.

If the User wishes to receive newsletters, they may consent to this during registration or later on the website by placing an “X” in the checkbox next to “Subscribe to newsletter”.

2.4. The Data Controller processes the following data:

In case of registration: name of the data subject (surname, first name); email address; county and city; indication that the person has reached the age of 16.

In case of newsletter subscription: name of the data subject (surname, first name); email address; county and city.

2.5. Purposes of data processing: registration on the website https://forgarden.hu/ (first purpose) and sending newsletters (second purpose).

Legal basis of data processing: voluntary consent of the data subject

Duration of data processing:

In case of registration: until the user account is deleted at the request of the user.

In case of newsletter subscription: until the day of unsubscribing from the newsletter.

2.6. Persons authorized to process data: the current managing director of the service provider and its employees. The processed data are known only to the current managing director and employees.

2.7. The Data Controller does not transfer data to third parties in connection with the use of the service. The processed data are not transferred to a data controller or processor located in a third country.

2.8. The Data Controller reserves the right – and obligation – to unilaterally modify this Privacy Notice in order to ensure compliance with the applicable legal requirements.

  1. Rights of the data subject

3.1. The data subject may request information from the Data Controller regarding the processing of their personal data. Upon request, the Data Controller provides information about the data processed, the purpose, legal basis and duration of the processing, the name and address of the data processor, and the activities related to data processing.

The Data Controller shall provide the requested information in writing – as soon as possible but no later than 25 days from the submission of the request.

3.2. The data subject may request the correction of their personal data.

If the personal data are incorrect and the correct data are available to the Data Controller, the personal data will be corrected.

3.3. The data subject may request the deletion or restriction of their personal data.

Personal data must be deleted if:

  • the processing is unlawful;
  • the data subject requests it;
  • the data are incomplete or incorrect;
  • the purpose of data processing has ceased or the storage period has expired;
  • the court or the authority has ordered it.

The Data Controller may refuse a deletion request only in cases of mandatory data processing (e.g. invoice retention obligation under accounting law).

Instead of deletion, the Data Controller restricts the personal data if the data subject requests it or if, based on the available information, it can be assumed that deletion would violate the legitimate interests of the data subject.

Such restricted personal data may only be processed as long as the purpose of processing that excluded deletion exists.

If the Data Controller does not comply with the request for correction, restriction or deletion, it shall inform the data subject within 25 days of the reasons for the refusal, including the factual and legal grounds.

In case of refusal, the Data Controller informs the data subject about the possibility of judicial remedy and the possibility of turning to the Authority.

  1. Judicial enforcement; compensation; damages

4.1. If the data subject’s rights are violated, the data subject may bring the case before a court against the Data Controller.

If the Data Controller causes damage to another person through unlawful processing of personal data or by violating data security requirements, it must compensate for the damage.

If the unlawful processing of personal data violates the personality rights of the data subject, the data subject may claim compensation for non-material damage.

4.2. Anyone may initiate an investigation with the National Authority for Data Protection and Freedom of Information (NAIH) if they believe that a violation of rights has occurred or is likely to occur in connection with the processing of personal data.

5.1. Definitions used in this Privacy Notice
